1. Introduction
These Terms and Conditions form a binding agreement between you and Pecan Horizon Godo Kaisha when you use this website or engage our advisory services. Please read them before proceeding with a booking.
2. User obligations
- Provide accurate information when submitting inquiries or booking a session.
- Comply with applicable Japanese law when engaging our services.
- Refrain from using this site for unlawful or fraudulent purposes.
- Content and documents provided to us during a review or planning session must belong to you or be lawfully shared.
- These services are intended for business use by owner-managers and staff; no specific age restriction beyond standard adult capacity to contract applies.
3. Liability and warranties
- Advisory findings and plans are offered as observations and suggestions; final business decisions remain the client's responsibility.
- We do not warrant specific financial outcomes from any engagement.
- To the extent permitted by law, our liability is limited to the fee paid for the specific engagement in question.
- We are not liable for indirect or consequential losses arising from decisions made based on our advisory work.
- Neither party is liable for delays or failures caused by events beyond reasonable control (force majeure).
4. Legal information and dispute resolution
- Governing law: These terms are governed by the laws of Japan.
- Jurisdiction: Any disputes will be subject to the jurisdiction of the courts having authority over Osaka, Japan.
- Dispute resolution: We encourage direct communication to resolve any disagreement before pursuing formal proceedings.
- Severability: Should a Japanese court set aside one clause of these terms, only that clause falls away; the rest of our engagement terms with you stay in force as written.
- Modification: These terms may be updated periodically; the version in force at the time of engagement applies.
5. Booking a format
A session is booked when we confirm the date and format in writing and you accept. For an Operational Review Session we agree beforehand which staff will be interviewed and which documents we will walk through; for Growth Planning Support we agree the three meeting dates within the six-to-eight-week window; an Advisory Retainer Hour is booked individually, online or at our Osaka office.
6. Preparation and materials
The quality of a session depends on what we see in advance. You agree to send the documents requested at least three business days before the session, and to let us know if figures are provisional. Material sent for an advisory hour is read before the call so that the hour is spent on the question, not on background.
7. Fees and cancellation
Fees are those shown on the offers page when the booking is confirmed: ¥18,000 for an Operational Review Session, ¥27,500 for Growth Planning Support and ¥9,800 for an Advisory Retainer Hour. They are invoiced on booking and payable within thirty days. A session can be moved once without charge with three business days' notice; later cancellations are charged in full, except where we are the ones who cannot attend.
8. Nature of our advice
Our summaries and models describe how your business currently works and set out options for the year ahead. They are not accounting, tax or legal advice and do not guarantee any result. Decisions about opening a location, hiring or changing a product line remain with you.
9. Confidentiality
We keep confidential what we learn about your business during a session, including interview content and figures, and we ask you to treat our working materials in the same way. Summaries and models may be shared within your organisation and with your advisers, such as your accountant or bank.
10. Limitation of liability
Except in cases of intent or gross negligence, our total liability for any session or series of meetings is limited to the fee paid for it. We are not liable for lost profit or other indirect loss resulting from a decision taken after a session.
11. Entire agreement
These terms and the written booking confirmation together make up the agreement for a session. Where they differ, the booking confirmation prevails, since it records what was agreed for your particular question. Japanese law governs both.
12. Changes to these conditions
We may update these conditions when our formats change. A session already booked continues under the conditions that applied when it was confirmed. The current version is always the one published on this page, and earlier versions are available on request if you need to check what applied to a past booking.
